By accessing or using 1PM AI's website, software, AI agents, and related services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our site or services.

1PM AI provides AI-powered sales and marketing solutions, including:

• AI Inside Sales Agents (ISA) and Outside Sales Agents (OSA).
• AI voice, chat, and SMS automation.
• CRM, booking, and outreach automation tools.
• Lead generation, qualification, and conversion workflows.
• Onboarding, strategy, and ongoing optimization support.

Access to 1PM AI is provided under a subscription license, not a transfer of ownership. You receive a limited, non-exclusive, non-transferable right to use the platform during the period covered by your active plan, subject to the terms of your chosen plan (DIY, DWY, or DFY).

You agree to:

• Comply with all applicable laws, including TCPA, CAN-SPAM, GDPR, and CCPA, when using outreach features.
• Obtain proper consent from contacts before initiating automated calls, texts, or emails.
• Not distribute account credentials or allow unauthorized individuals to access the platform.
• Not use the service to send spam, illegal content, or content that infringes others' rights.
• Not attempt to reverse-engineer, scrape, or interfere with the platform's operation.

Subscription fees are billed in advance according to the plan you select on our pricing page. Setup or onboarding fees may apply depending on plan tier. All fees are non-refundable except as expressly stated in your service agreement. Late or failed payments may result in suspension of access until the balance is resolved.

All content, software, trademarks, logos, models, and intellectual property associated with 1PM AI remain our exclusive property. You may not reproduce, distribute, or create derivative works without our express written permission. You retain ownership of the data and content you submit to the platform and grant us a limited license to process it solely to operate and improve the service for you.

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

You must be at least 18 years of age to access our website, create an account, use our services, or opt in to our SMS messaging program. By using our services you represent and warrant that you meet this age requirement.

Program Description: 1PM AI operates an SMS messaging program to communicate with customers, prospective customers, and event attendees. By providing your mobile number and opting in (via web form, written consent, or verbal confirmation), you consent to receive recurring automated text messages from us.

Use Cases: Messages may include account and subscription notifications, appointment and demo reminders, event invitations and RSVPs, customer support replies, billing reminders, onboarding updates, and occasional promotional offers related to our AI sales services.

Message Frequency: Message frequency varies depending on your interactions with us and the programs you opt into.

Message & Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your plan.

Opt-Out: You may opt out at any time by replying STOP to any message you receive from us. After replying STOP you will receive a confirmation and no further messages will be sent unless you opt in again.

Carrier Disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Message delivery depends on transmission from your network operator.

Privacy: Mobile information (phone numbers and SMS opt-in consent) is never disclosed, traded, or distributed to outside organizations for marketing purposes. See our Privacy Policy for full details.

To the maximum extent permitted by law, 1PM AI shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services, including loss of revenue, data, or business opportunities. The AI agents augment human sales teams and do not guarantee specific business outcomes.

Any dispute arising under these terms shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.

1PM AI reserves the right to modify these terms at any time with reasonable notice to customers. Continued use of the services after notification constitutes acceptance of the modified terms.
